Terms of Service

Welcome to Happy Neighbor Services (referred to herein as "Happy Neighbor Services", "we", "us", or "our"). These Terms of Service (our "Terms") set forth the terms and obligations between us, the company providing the Services, and you, our client (collectively, the "Parties"). All terms and obligations contained herein are legally binding. Your use of our cleaning, hauling, repair, or landscaping services (our "Services") constitutes explicit acceptance of all of the terms contained herein.

If Happy Neighbor Services might be a good fit for your needs, please contact us to receive a quote. Quotes we provide are estimates based on the scope of work and the condition of the home as described at time of booking. Jobs sometimes end up larger than described, or something out of our control may cause the quote to increase. Before charging an increase, we will notify you in writing and you must accept before we move forward. All increases will be invoiced at the end of your project.

Happy Neighbor Services agrees to perform the Services listed on your quote. If a service you need is not on the quote, it is your responsibility to ensure necessary work is added. All work will be done by one or more of our agents; when you hire Happy Neighbor Services, you are hiring the company, not an individual employee.

Arrival times are estimates only. If we are delayed, we will communicate as soon as possible. You agree to give us access to your home. We recommend — but do not require — that you are home before and after our Services so that you can review the job.

Quality of Work — Other Workers Present. We cannot guarantee quality of work if additional unaffiliated workers are present (movers, handymen, contractors, etc.) during our Services.

Scope Exclusions. The following are not included in standard cleaning packages unless expressly quoted: wall washing, tile grout & caulking deep cleaning, interior of dishwashers, and exterior cleaning (exterior windows, hardscape, driveways, outdoor areas).

Quotes are free and expire after thirty (30) days. We offer three purchasing options:

Flat Fee Services — pricing based on nature of work, time, workers required, and other factors, subject to change based on changes in scope.

Hourly Services — billed in fifteen (15) minute increments. We clean as much as possible within time purchased and cannot guarantee that every requested task will be completed. Additional time may be added before we depart at the hourly rate specified in your quote.

Recurring Cleaning Service — weekly or monthly plans that automatically renew. Cancel any time per these Terms.

If required, you agree to pay a Deposit to reserve Happy Neighbor Services for selected dates or timeframes. The Deposit is non-refundable and will be applied to the total balance owed. You are not reserved until the Deposit is paid.

All prices are in U.S. Dollars. We accept most forms of payment, including Zelle, credit card, and debit card. We reserve the right to change our Services or pricing at any time with thirty (30) days advance written notice for Recurring Cleaning Service changes.

By providing a payment method, you authorize us to charge it for all charges you incur. Denied payments incur a $50.00 administrative fee. Invoices are due within forty-eight (48) hours of receipt; unpaid invoices accrue interest at 3% per month and may be sent to collections after thirty (30) days, in which case you are responsible for collection costs and reasonable attorney's fees.

Chargebacks are not permitted. If you charge back a payment, you agree to pay a $5,000 liquidated damages penalty in addition to amounts owed.

Happy Neighbor Services represents and warrants that the Services will be performed in a professional manner consistent with or exceeding industry standards, and that we maintain industry-standard liability insurance.

All sales are final. We do not provide refunds under any circumstances. Cancellations or date changes must be made at least twenty-four (24) hours prior to scheduled start time.

• Cancellation while our team is en route: $68.00 trip fee; remaining balance refunded.
• Cancellation after our team has arrived on-site: no refund.
• Cancellation within 24 hours (before team is en route): we retain the Deposit, applied to your next booking.

Our Satisfaction Guarantee. If a job is not completed to your satisfaction, we will return to re-do the work within forty-eight (48) hours of your written notice of dissatisfaction. Failure to notify us within 48 hours forfeits the guarantee.

To keep our team safe, we do not perform:

• Cleaning beyond what is reachable from a two-step ladder.
• Cleaning of biohazard substances.
• Cleaning of areas infested with insects or other animals.
• Cleaning of areas with mold or other toxins.
• Any tasks that could jeopardize health, wellness, or safety of our workers.

Undisclosed Pest Infestation Policy. If a pest or bug infestation is not disclosed prior to arrival, we reserve the right to refuse service without refund.

Pets. You are responsible for the care of pets during Services.

Personal Property & Valuables. Please put away wallets, jewelry, cash, sensitive documents, and other valuables prior to our arrival. Point out or remove irreplaceable or specialty items. We do not assume liability for damage resulting from cleaning of items we were not informed about.

Fixtures. Fixtures and home décor must be in good working order.

Security Deposits. We are not responsible for the outcome of any security deposit evaluation or dispute.

Move-In & Move-Out Cleanings. Access is required to honor our Satisfaction Guarantee. If keys are turned in and access is lost, the guarantee is considered fulfilled.

Unexpected Property Conditions. If a home materially differs from what was described at booking, we will notify you and you may approve additional time at an adjusted rate or have us complete as much as possible within the original scope.

If you are unhappy, please contact us first so we can make it right. You grant Happy Neighbor Services a seventy-two (72) hour cure period to fix, re-do, or remedy any Services not completed to your satisfaction before posting a negative review. Untruthful reviews may result in pursuit of damages, including recovery of attorney's fees.

You agree not to solicit or hire, directly or indirectly, any person employed by Happy Neighbor Services. Breach of this section results in liquidated damages of $1,000 per violation, in addition to any other available remedies.

By using our Services, you permit Happy Neighbor Services to take before and after photographs of the work performed for marketing, advertising, and promotional purposes. No royalty or compensation will be due for any such use.

The contents of our website are protected by U.S. and international copyright laws. All content is owned exclusively by Happy Neighbor Services or licensed to us. You may not reproduce, distribute, display, sell, transfer, license, or use for commercial purposes any content on our website without prior written consent.

OUR SERVICES ARE PROVIDED "AS IS". TO THE EXTENT PERMITTED BY LAW, HAPPY NEIGHBOR SERVICES DISCLAIMS ALL REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE TOTAL AMOUNT YOU PAID HAPPY NEIGHBOR SERVICES FOR THE SERVICES. NO CLAIM MAY BE BROUGHT MORE THAN ONE (1) YEAR AFTER THE CAUSE OF ACTION AROSE.

Each party shall indemnify and hold harmless the other from any losses, damages, liabilities, attorney's fees, and expenses arising from (a) use of the Services; (b) that party's breach of these Terms; or (c) applicable law.

Entire Agreement. These Terms contain the entire agreement between you and Happy Neighbor Services except for inclusions in a quote.

Applicable Law / Dispute Resolution. These Terms shall be governed by the laws of the State of Texas. Except for non-payment or untruthful reviews, all disputes shall be resolved through binding arbitration in Dallas County, Texas. The prevailing party is entitled to reasonable attorney's fees and costs.

Waiver of Class Action. Any dispute is personal to you and Happy Neighbor Services and will not be brought as a class action or similar proceeding.

Severability. If any provision is held invalid, the remaining provisions continue to be valid and enforceable.
